Section 702: What It Authorizes and How It Is Used

January 18, 2018

Episode Notes:

Last week, the House voted to extend Section 702 of the Foreign Intelligence Surveillance Act with bipartisan support. Earlier this week, the Senate passed a procedural hurdle that suggests it’s passage and extend the authorities in the section until 2024. A controversial tool for the intelligence community, the success of the extension was brought into questions as President Trump tweeted both for and against it the morning of the House vote. Jennifer Daskal, an associate professor of law at American University’s Washington College of Law and an editorial board member at Just Security, talks with Jason about this authority.
